The mechanism of the state in the context of human rights in the conditions of the information society

Abstract

the article analyzes the changes occurring in the state mechanism in connection with the formation and further development of the information society. The definition of the information society as a system of human relations in the conditions of rapid development of information and computer technologies is presented. It is noted that the formation and further development of the information society causes the problem of adjustment (adaptation) to it of all aspects of human life. It is argued that such an adaptation applies, in particular, to the political system of mankind. First of all, its main element is the state. Its further evolution in the conditions of the information society is closely related to network management. That is, a system of horizontal connections between individual elements of the state and the state with two other elements of the political system of society - civil society and local self-government. The problem of network management as a key to the successful functioning of the political system is connected with the concept of "state mechanism". At the same time, the mechanism of the state is actually identified with network management. The mechanism of the state, in turn, is considered as a system consisting of the following three elements: a) state apparatus (bureaucracy); b) participation of citizens in the management of state affairs; c) communication (primarily electronic) of citizens and the state. This interpretation of the concept of "state mechanism" and its identification with network management is connected with the changes introduced by the information society in the functioning of the state as a political institution. At the same time, state legislation on communication between citizens and the state is considered - on the example of Ukraine. These are the laws of Ukraine "On information", "On access to public information", "On appeals by citizens". The further development of the state in the conditions of the information society, taking into account the factor of the mechanism of the state as network management, is connected with the study of various forms of state government and state structure: polycracy, monocracy, unitary and federal state (federation). Attention is drawn to the importance of the state mechanism in the conditions of a polystate: a unitary or federal state, which includes territories (regions) with different political and legal status. It is noted that conducting research in this direction is a relevant and necessary scientific search.
