The state mechanism of the subject of the federation in the theory of the state and law

Abstract

The article analyzes the changes taking place in the management mechanism of the federal state in connection with the formation and further development of the information society. The definition of information society as a system of human relations in the conditions of rapid development of information and computer technologies is presented. It is noted that the formation and further development of the information society determines the problem of adaptation (adaptation) to it of all aspects of society's vital activities. In particular, its political system. And above all, its main element is the state. It is explained that in the conditions of the further evolution of the state (in particular, under the influence of the processes of globalization and glocalization), the federal form of government has great prospects. Its further evolution in the conditions of the information society is closely related to network management. That is, a system of horizontal connections between individual elements of the state, as well as the state with two other elements of the political system of society - civil society and local self-government. It is noted that in relation to a federal state, network management is of great importance for the establishment of effective management relations both between the federation and its subjects (vertical relations), and between the subjects of the federation themselves (horizontal relations). The problem of network management as a key to the successful functioning of the political system is related to the concept of "state mechanism". At the same time, the mechanism of the state is actually identified with network management. The mechanism of the state, in turn, is considered as a system consisting of the following three elements: a) state apparatus (bureaucracy); b) participation of citizens in the management of state affairs; c) communication (primarily electronic) of citizens and the state. This interpretation of the concept of "state mechanism" and its identification with network management is related to the changes that the information society brings to the functioning of the state as a political institution. Phenomena that directly affect the effectiveness of the state mechanism of the subject of the federation are analyzed on the example of various federal states of the world. Namely: questions regarding the sovereignty of the subject of the federation, the distribution of powers of the federal government and the power of the subjects of the federation, management institutions of the subject of the federation, symmetry and asymmetry in the construction of the federal state (different political and legal status of the subjects of the federation). Attention is also drawn to the possibility of the presence of federal territories within the federal state as elements affecting the state mechanism of the subject of the federation. Attention is drawn to the importance of the state mechanism in the conditions of a polystate: a federal state that includes territories (regions) with different political and legal status. It is noted that conducting further research in this direction is a relevant and necessary scientific search.
